What is the effective date?
By August 5, 2021, employers with worksites in New York must adopt a model infectious disease exposure plan or develop an alternative plan that meets or exceeds minimum standards under the New York HERO Act.


Who is covered?
All private employers in New York State, regardless of size.


Does the Safety Plan apply only to COVID?
No. It applies to any viral, bacterial, or fungal disease that is spread through the air in the form of aerosol particles or droplets, and that is designated by the New York State Department of Health as a highly contagious disease.


When does the Safety Plan need to be activated?
While the Safety Plan must be written and distributed, it only to be activated when advised  on the DOL website: https://dol.ny.gov/ny-hero-act. At this time, employers are not required to activate the procedures set forth in their prevention plans.


When does the Safety Plan need to be distributed?
Distribute the plan to employees within 30 days after adoption, but no later than September 4, 2021


When will I receive the Safety Plan from Sandpiper?
Once payment is processed, we will review your company information and you will receive an email from our team within 1-2 business days. Included in the email will be industry specific company questionnaire. Once completed, our team will generate your customized Safety Plan within 7-10 business days.
 

Should I have my legal team review the document?
The Safety Plan produced by Sandpiper is in best practice, industry standard format. Sandpiper is not able to provide legal advice. Please refer to your legal advisor for any further customization needed.
